BY USING OR ACCESSING THIS SITE YOU AGREE TO BE BOUND BY THE FOLLOWING TERMS WHICH MAY BE CHANGED, UPDATED OR AMENDED FROM TIME TO TIME.
1. TRADEMARKS
RPH, its related companies, affiliates, contractors and/or participating corporations are the owners of the trade and service marks appearing on this Site and all rights are reserved in respect of such trade and service marks.
2. USE OF INFORMATION AND MATERIALS
The information and materials contained in this Site and the terms, conditions, and descriptions that appear, are subject to change. Your eligibility for particular products and services is subject to RPH’s final determination and acceptance.
3. PROPERTY DEVELOPMENT DISCLOSURES AND SPECIFICATIONS
The show flat visuals, art renderings, illustrations, videos, pictures, and other graphic representations featured on this Site are artists’ impressions only and are not intended to represent the actual unit or development sold by RPH. All information, plans, and specifications are current at the time of publication and are subject to such changes and deviations as may be required by RPH or the relevant authorities. All areas and measurements stated herein are approximate and remain subject to adjustment on final survey. Nothing contained on this Site shall form part of an offer or contract, nor shall it be construed as a representation of fact by RPH or its agents. The Developer shall not be bound by any statements or promises (whether written or oral) unless expressly set forth in the Sale and Purchase Agreement. The Sale and Purchase Agreement shall form the entire contract between the Developer and the Purchaser, superseding all prior statements or representations, and may only be modified in writing and with the approval of the Controller of Housing where required.
4. THIRD PARTY SERVICES AND HYPERLINKS
This Site may contain links to external websites or resources that are not maintained or controlled by RPH. RPH does not monitor, endorse, or verify the contents, accuracy, or opinions expressed on such third-party sites. Your access to and use of any linked websites is entirely at your own risk. RPH shall not be responsible or liable, directly or indirectly, for any damage or loss caused by your reliance on any content, goods, or services available on or through any such external sites. This Section 4, read together with Section 4A (Third-Party Software and Extensions), constitutes the full disclosure of RPH’s limited liability regarding all third-party interactions initiated through this Site.
4A. THIRD-PARTY SOFTWARE AND EXTENSIONS
To access certain features of this Site, you may choose to utilize third-party software, browser extensions, or applications which are licensed to you by third parties and not by RPH. As these third-party tools are not developed or maintained by RPH, RPH makes no warranties regarding their merchantability, security, or fitness for any particular purpose. RPH shall not be responsible for any defects, computer viruses, or data breaches arising from your use of such third-party software.
5. RIGHTS OF THIRD PARTIES
A person who is not a party to these Terms shall have no right under the Contracts (Rights of Third Parties) Act (Cap. 53B) to enforce any of its terms.
6. LANGUAGE
If the information on this Site is translated into or presented in languages other than English, the English version of that information will prevail in relation to any disputes regarding its interpretation.
7. NO WARRANTY
The information and materials contained in this Site, including text, graphics, and links, are provided on an “as is” and “as available” basis. RPH does not warrant the accuracy, adequacy, or completeness of this information and expressly disclaims liability for any errors or omissions therein. To the fullest extent permitted by law, RPH disclaims all warranties of any kind, whether implied, express, or statutory, including but not limited to warranties of non-infringement of third-party rights, title, merchantability, fitness for a particular purpose, and freedom from computer viruses or other malicious code. For specific disclosures regarding property specifications, measurements, and artistic renderings, please refer to Section 3 (Property Development Disclosures and Specifications).
8. DATA PROTECTION STATEMENT
Your use of this Site is also governed by our Data Protection Policy, which explains how we collect, use, and disclose your personal data in accordance with the Singapore Personal Data Protection Act 2012 (PDPA).
9. EXCLUSION OF LIABILITY
To the maximum extent permitted by law, RPH shall not be liable for any damages, including without limitation direct or indirect, special, incidental, or consequential damages, losses, or expenses arising in connection with this Site, the use thereof, or the inability to use by any party. This includes, but is not limited to, reliance on Site content, failure of performance, errors, omissions, interruptions, defects, delays in operation or transmission, computer viruses, cybersecurity incidents, or line or system failures, even if RPH or its representatives are advised of the possibility of such damages. Nothing in these Terms shall limit or exclude RPH’s liability for death or personal injury caused by its negligence, or for any other liability that cannot be excluded or limited under Singapore law.
10. INDEMNITY
You agree to fully defend, indemnify, and hold harmless RPH, its related corporations, affiliates, officers, directors, employees, agents, and contractors from and against all liability, losses, damages, costs, and expenses (including legal costs on a full indemnity basis) arising out of or in connection with your use or misuse of this Site, any breach by you of these Terms of Use, or any claim by a third party relating to your actions. Such claims shall include, without limitation, those based upon trademark or service mark infringement, copyright infringement, tradename infringement, dilution, passing off, defamation, tortious interference with contract or prospective business advantage, conspiracy, or injury to business reputation.
11. SUBMISSION
All information submitted to RPH via this Site shall be deemed and remain the property of RPH, who shall be free to use, for any purpose, any ideas, concepts, know-how, or techniques contained in such information, provided that any personal data included within such submissions shall be handled strictly in accordance with RPH’s Data Protection Policy and the Personal Data Protection Act 2012. Except as required by Singapore law or as expressly agreed upon in a separate written agreement, RPH shall not be subject to any obligations of confidentiality regarding submitted information that does not constitute personal data. By submitting any materials, you represent and warrant that such materials are your own or that you have the legal right to provide them, and that they do not infringe upon the rights of any third party.
12. GOVERNING LAW & JURISDICTION
These Terms of Use shall be governed by and construed in accordance with the laws of the Republic of Singapore, and you hereby submit to the exclusive jurisdiction of the Singapore courts; provided, however, that RPH reserves the right to initiate legal proceedings in any other court of competent jurisdiction. A person who is not a party to these Terms of Use shall have no right under the Contracts (Rights of Third Parties) Act 2001 to enforce any of its terms. You further agree that all notices, disclosures, and other communications provided to you electronically by RPH satisfy any legal requirement that such communications be in writing in accordance with the Electronic Transactions Act 2010.
13. SEVERABILITY
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
